Public sector contracts are usually awarded via a tendering procedure, which is divided into an EU-wide or national tender. Above a certain threshold, tenders must be EU-wide. Stricter, uniform laws and regulations then apply. For services, the threshold value is € 221,000 net. Efficient processing requires expertise in order to quickly determine whether this tender is relevant for us.
That's why we at punkt.de are proud to have a certified procurement manager.
The process begins with the tender being published. In accordance with the principle of transparency, there is an obligation to publish all procurement projects, which marks the official start of the procurement process and provides initial information for potential bidders. It is important that the applicable deadlines are adhered to and that the specifications are carefully prepared. As a bidder, tenders can be submitted within the specified deadline.
In the case of EU contracts, preliminary information is provided before the contract is awarded. Contract law only comes into force once the contract has been awarded. In the IT sector, there are special Supplementary Contract Terms for the Procurement of IT Services (EVB-IT). Both the federal government and the federal states are obliged to use them by the administrative regulations § 55 BHO and § 55 LHO. The EVB-IT was issued by the Federal Ministry of the Interior and negotiated with BITKOM. A contract is required to agree its use.
The EVB-IT offers various contract types covering services, software, hardware, cloud services and entire IT systems. If several service types and contract types are required, so-called system contracts can be concluded. These contracts set out the applicable contractual terms and conditions as well as the handling of service disruptions and liability issues.
We at punkt.de are aware of these processes and have a competent contact person for all matters relating to tenders in our procurement manager.
In addition, we have already drawn up a Scrum service contract ourselves in accordance with EVB-IT so that we can also incorporate the agile process. In this respect, we are ahead of the official bodies that are currently working on such a contract.
We also provide support and advice in the preparation of specifications and tenders. If you have any questions or concerns, you are welcome to contact us directly at any time via vertrieb@punkt.de
