Public sector contracts are usually awarded through a bidding process, which is divided into EU-wide and national tenders. Above a certain threshold, tenders must be open to the entire EU. In such cases, stricter, uniform laws and regulations apply. For services, the threshold is €221,000 net. To handle these efficiently, expertise is needed to quickly determine whether a given call for bids is relevant to us.

The Process
The process begins with the publication of the tender notice. In accordance with the principle of transparency, there is an obligation to publish all procurement projects, which marks the official start of the procurement procedure and provides initial information for potential bidders. It is important to meet the applicable deadlines and to carefully draft the statement of work. Bidders may submit bids within the specified timeframe.
In the case of EU procurements, a prior information notice is issued before the contract is awarded. Contract law only takes effect once the contract is awarded. In the IT sector, there are special Supplementary Contractual Conditions for the Procurement of IT Services (EVB-IT). Both the federal government and the states are required to use them under the administrative regulations § 55 BHO and § 55 LHO, respectively. The EVB-IT was issued by the Federal Ministry of the Interior and negotiated with BITKOM. A contract is required to agree to their use.
The EVB-IT offers various contract types covering services, software, hardware, cloud services, and entire IT systems. If multiple types of services and contract types are required, so-called system contracts can be concluded. These contracts set forth the applicable contractual terms and conditions as well as the procedures for handling service disruptions and liability issues.
